At the request of the state of Kentucky, the E.P.A. will be conducting three hearings in June on their objections to 36 coal-mining water quality permits. The hearings are to resolve the status of these 36 permits and how to enforce water quality regulations at new or expanded surface mines.

These permits were issued during 2010-11 and were challenged by the E.P.A. as to whether or not the permits sufficiently protect water quality from mining activities such as blasting and then filling streams with the rubble, which is a common practice in mountaintop-removal mine sites.

The E.P.A. has blocked these 36 permits with formal objection letters, citing the issue of conductivity, which is a measure on how easily water conducts electricity. Streams with high conductivity typically are less able to support biological activity for small creatures in the food chain.

The state of Kentucky, in its own accounting, cites that 1,199 miles of streams in the upper Kentucky River watershed are impaired, with coal mining being cited as the suspected source of the impairment.

We are asking members of the Cumberland Chapter to be involved in preparation for these hearings. Your participation on this issue will be paramount in helping us support the E.P.A.’s ability to keep our waterways from being further impacted by mountaintop mining.
